⚠️ Important: QR Guard is a verification tool, not a payment processor. You are solely responsible for verifying QR codes before making any payments. We do not guarantee the accuracy of community reports or safety scores.

1. Agreement to Terms

By downloading, accessing, or using QR Guard ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and QR Guard ("we," "our," or "us").

2. Description of Service

QR Guard is a mobile application that provides:

QR Code Scanning: Scan and decode QR codes and barcodes using your device camera
Community Safety Reports: View and submit user reports about QR code safety
Trust Scoring: Display community-generated trust scores for QR codes
QR Code Generation: Create custom QR codes with branding options
Living Shield™: Monitor QR code destinations for changes (premium feature)
Local History: Store your scan history privately on your device

3. Eligibility

You must be at least 13 years old to use QR Guard. By using the App, you represent and warrant that:

You are at least 13 years old
You have the legal capacity to enter into these Terms
Your use of the App does not violate any applicable law or regulation

4. Account Registration

4.1 Optional Accounts

Most features of QR Guard can be used without an account. However, to access certain features (saving generated QR codes, submitting reports, merchant verification), you may need to create an account using Google Sign-In.

4.2 Account Security

You are responsible for:

Maintaining the confidentiality of your Google account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

5. User Responsibilities

5.1 Acceptable Use

You agree to use QR Guard only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the App to scan QR codes for illegal, fraudulent, or harmful purposes
Submit false, misleading, or malicious scam reports or comments
Attempt to hack, reverse engineer, decompile, or modify the App
Use the App to harass, threaten, defraud, or harm other users
Interfere with or disrupt the App's servers, networks, or Firebase infrastructure
Automate access to the App (bots, scrapers, scripts) without our written permission
Impersonate any person or entity or misrepresent your affiliation

5.2 Content You Submit

When you submit comments, reports, or other content to QR Guard:

You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the App
You represent that you own or have the necessary rights to submit the content
You are solely responsible for the content you submit and its accuracy

5.3 QR Code Verification Responsibility

⚠️ Critical Disclaimer: QR Guard provides community-powered safety information as a tool to assist your decision-making. YOU are solely responsible for verifying the legitimacy of any QR code before making payments or sharing sensitive information. We do not guarantee the accuracy, completeness, or timeliness of any safety reports or trust scores.

6. Disclaimer of Warranties

6.1 "As Is" Service

QR Guard is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 No Guarantee of Accuracy

We do not guarantee that:

All malicious QR codes will be detected or flagged
Community reports and trust scores are 100% accurate or unbiased
The App will be error-free, uninterrupted, or secure
QR codes you generate will work with all scanning applications
Living Shield™ monitoring will detect all destination changes in real-time

6.3 Third-Party Content

QR Guard displays content from third parties (user reports, merchant information, QR code destinations). We do not endorse, verify, or take responsibility for third-party content.

7. Limitation of Liability

7.1 No Liability for Financial Loss

To the maximum extent permitted by applicable law, QR Guard and its developers, affiliates, and contributors shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Financial losses from scanning malicious QR codes
Fraudulent transactions or unauthorized payments
Reliance on inaccurate community safety reports
Data loss, corruption, or unauthorized access
App errors, crashes, or service interruptions

7.2 Maximum Liability

In no event shall our total liability to you for all claims arising out of or related to your use of QR Guard exceed INR 1,000 (One Thousand Indian Rupees).

7.3 Basis of Bargain

The limitations and exclusions of liability in this section apply to all claims, regardless of the legal theory (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless QR Guard, its developers, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights (including intellectual property or privacy rights)
False, misleading, or malicious content you submit
Your negligence or willful misconduct

9. Intellectual Property

9.1 Our Intellectual Property

QR Guard and its original content, features, functionality, design, and branding are owned by QR Guard and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download, install, and use the App for personal, non-commercial purposes
Access and use the App's features in accordance with these Terms

9.3 Restrictions

You may NOT:

Copy, modify, or create derivative works of the App
Remove any proprietary notices or labels from the App
Use the App for commercial purposes without our written permission
License, sell, rent, lease, transfer, or distribute the App

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue QR Guard (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

11. Termination

We may terminate or suspend your access to QR Guard immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising out of or relating to these Terms or your use of QR Guard shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.

12.3 Arbitration (Optional)

For disputes under INR 10,00,000 (Ten Lakh Rupees), you agree to first attempt good-faith negotiation. If unresolved within 30 days, either party may initiate binding arbitration in Kerala, India under the Arbitration and Conciliation Act, 1996.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via:

In-app notification with a summary of changes
Email notification (if you have provided an email address)
Prominent posting on our website with the updated Terms

Your continued use of QR Guard after the effective date of changes constitutes your acceptance of the new Terms. If you do not agree to the changes, you must stop using the App.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QR Guard regarding your use of the App and supersede all prior or contemporaneous agreements, representations, or understandings.

You understand these Terms
You agree to be bound by these Terms
You accept all risks associated with using QR Guard, including the risk of financial loss from QR code scams
